General Terms & Conditions of Sales

 

 

1. SCOPE

These general conditions of sale apply to any purchase of products made on the online store: www.fashion-art-gallery.ch, belonging to Fashion Art Gallery, a company registered with the Geneva commercial register.

The specific conditions for the purchase of products on the website are defined below. Online product offers are valid only as long as they are visible on the site and within the limits of available stocks.

2. CONCLUSION OF THE CONTRACT AND SUBSCRIPTION TO THE NEWSLETTER

A sales contract is deemed to have been concluded between the parties when the online store www.fashion-art-gallery.ch has confirmed the order to the customer in writing. The order confirmation is sent to the customer by e-mail. From this moment, the customer is subject to these general conditions of sale.

However, we reserve the right to refuse the order at our convenience, without giving reasons. In this case, the customer is informed and any payments already made are refunded. We may refuse the order due to unauthorized payment; when a product is not in our warehouse or does not meet our quality control standards and must therefore be removed; or the customer does not meet the criteria set out in our GTCS.

2.1 NEWSLETTER

When confirming the order, the customer has the choice whether or not to subscribe to the newsletter. The newsletter is only sent to customers if they expressly request it. The subscription to the newsletter can be terminated at any time. Details in this regard can be found in the newsletter.

 

3. PRICES OF ARTICLES

The prices stated in the offer at the time of the order apply. Prices are displayed in Swiss francs, include all taxes (including VAT, 8.1 % VAT included, VAT number CHE-292.721.605). We reserve the right to change prices at any time without notice. We reserve the right not to deliver products for which the prices displayed are incorrect. However, we undertake to inform customers of a price difference and we will allow ourselves to offer alternative products. We can carry out sales or promotions on our assortment. These offers are valid only during the period of publication on the site and cannot be requested retroactively. The discount vouchers offered or purchase vouchers distributed on the site or through partner sites are exclusively valid online under the conditions set out in the offer. These vouchers can only be used when ordering and the field provided for this purpose must be used. Under no circumstances can a voucher be applied retroactively. Our customer service is at your disposal to help you in this type of situation.

 

4. PRICE GUARANTEE

At certain times of the year, we offer sales or promotions on a selection of products. The objectives of these discounts are various, but in general, the aim is to offer the product at a better price when the season ends and the chances of selling it at the normal price are reduced. It is therefore logical that by purchasing a product at a given time, a customer cannot in principle claim compensation for any price reductions on this product subsequently.

5. CHANGE OF ADDRESS OR NAME

We thank you for informing us of any change of address or name before placing an order in order to guarantee the correct delivery of your parcels.

 

6. PASSING OF RISKS

The transfer of risk takes place with the delivery of the goods.

7. DELIVERY AND TRANSPORT

Packages are generally dispatched within 48 hours after receipt of your payment. The delivery address must be in Switzerland. The products are delivered to the address indicated by the consumer on the order form. 

The consumer is required to check the condition of the packaging of the goods on delivery and to report the damage due to the carrier on the delivery note, as well as to the company, within one week.

Delivery costs are free. We reserve the right to divide an order into several packages or to combine several orders in the same package with the same delivery address.

7.1 AVAILABILITY AND DELIVERY TIME

The delivery times indicated at the time of validation of your order are purely indicative. They begin to run from the order, respectively upon receipt of payment.

We undertake to send your order to you within two working days provided that all the items ordered are in our central stock. Some products may not be in our central warehouse; it takes an additional delivery time of 2-3 days for the shipment of the order.

Depending on the availability of certain items in one of our remote warehouses or due to sales periods, additional delivery times may occur. This is the reason why all information relating to the delivery time is given for information only and can be modified at any time.

If we cannot meet the provisional delivery date, the customer is entitled to cancel the order in writing to customer service.

7.2 INFORMATION ON THE SENDING OF YOUR PACKAGE

All shipments are made by postal service. The general terms and conditions of Swiss Post Ltd also apply and can be viewed, among other things, at www.post.ch.

8. NO PURCHASE OBLIGATION, RIGHT OF RETURN

Satisfied or refunded. For online orders, we undertake to take back all goods within 30 days from the day of your order and reimburse you as soon as possible, in general, the reimbursement is made by the same means of payment as the original payment, within 2 to 20 days (depending on the circumstances).

Only items that are unused, clean, in perfect condition, labeled, and in their original packaging can be returned or exchanged. 

After receipt of the goods, Fashion Art Gallery checks that they are in good condition and, if necessary, decides on a refund. As soon as the distribution center has received and checked your return, the refund will be credited by the same means of payment as the one used to pay for your order.

The shipping costs in the case of a return of goods are the responsibility of the customer.

 

9. PAYMENT TERMS

We accept VISA, MasterCard, Amex, Discover, VISA Electron, Maestro, ChinaUnionPay, Jcb, Diners, CartesBancaires, Klarna online bank transfer, PayPal, Apple Pay, TWINT.

All payments are secure thanks to our partner SECTIGO. For payments by credit card, no data relating to your card is directly processed or recorded. Your data is processed by the transaction partner. During a refund, we can then almost instantly credit the transaction to this same payment method. You can also pay for your order by bank transfer. When choosing this means of payment, we advise our kind customers to make the transfer as soon as possible thanks to the information received by email, not forgetting to mention the reference number in the space provided. Upon receipt of payment, we will send the package the same day. Please note that we cannot keep your order on hold indefinitely and will only reserve it for 3 working days. Make your transfer as soon as possible!

 

10. RETENTION OF OWNERSHIP

Until full payment of the articles, we reserve in any case the property of the delivered goods.

 

11. REFUND IN CASE OF RETURN

Refunds will be credited to the payment method you have selected as soon as the returned items have reached our warehouse under the conditions mentioned in point 8 of these GTCS. A confirmation e-mail will then be sent to you, informing you of the reception of your articles and the refund made.

 

12. PRODUCT WARRANTY

We assume the guarantee for the absence of hidden defects of the goods delivered for a period of 2 years from the date of purchase. Therefore, the legal warranty for defective products applies. We expressly reserve the right, in the event of reported and observed defects of the purchased item, to deliver a replacement item free of defects within the limits of available stocks.

Items covered by a guarantee are subject to the conditions of the offer valid at the time of purchase. Your invoice acting as a guarantee, we ask you to keep it carefully. The warranty does not cover normal wear and tear as well as the consequences of improper handling, non-compliance with the instructions for use, poor maintenance of the product or deterioration by the customer, as well as defects attributable to external circumstances. Items that are worn, soiled, or damaged are notably excluded from the guarantee.

 

13. DATA PROTECTION AND ACCURACY

For all means of payment, the customer undertakes to provide exact and correct data. The use of false data or the misuse of identity is considered fraud and is punishable by law within the meaning of article 146, respectively article 147 of the CP, and will be prosecuted criminally.

All customer data is treated in a strictly confidential manner and we are committed to respecting the rules of ethics issued by the ASVPC as well as the legislation in force, in particular concerning data protection.

The data collected will only be used to process the order, for communication with the customer, for the planning and evaluation of commercial activity and marketing purposes, as well as for the design and development of services concerning the customer and for the development of tailor-made offers concerning him. By registering for the newsletter, the customer accepts that he is regularly informed of offers and that his data is also used in this way. At any time, the customer can contact customer service to be unsubscribed from newsletters.

14. SCOPE AND LAW OF APPLICATION

These conditions are subject to Swiss law. We reserve the right to modify these GTCS at any time. The range of products offered by us online is aimed exclusively at customers with a delivery address in Switzerland.
